Moulivakkam construction: HC grants interim stay

The Madras High Court on Monday granted an interim injunction on an order which prohibited construction activity, besides others, around the site at Moulivakkam where a multi-storeyed building collapsed killing over 60 lives in June last year.

Hearing a plea filed by Arun Enterprise, Justice M. Sathyanarayanan passed on interim injunction on the order passed by the then Kancheepuram Collector K. Baskaran on July 1 last year.

The order had cordoned off the site from public entry, directed the evacuation of people residing within 50 metre from the building to safer place and to stop any further construction activity on the premises.

Petitioner C. Dakshinamoorthy submitted that Arun Enterprise operating adjoining the collapse site was declared danger zone following the incident on June 28, 2014.

Despite representation to authorities, the property was not let out of the order of the District Collector.

Claiming that the Collector did not have the jurisdiction to pass such an order, he stated that the he was not informed of the order but could obtain it only through an RTI query.

As the order was passed without any period or time limit to the operation of the order, the Collector did not have any right to pass such an order without any specific period, the petition said and further sought to quash the order.
