‘Dead’ man appears in court

In a strange case, a person declared dead by the State police appeared before the Madras High Court and pleaded that he was alive and working for the Army. Following this, the High Court ordered a probe by an Inspector General of Police into the matter.

Noting that it was a serious issue, a Division Bench of Justices M. Jaichandren and S. Nagamuthu nominated A.G. Pon Manickavel, Inspector General of Police (IG), Idol Wing, Chennai as the Enquiry Officer.

According to the petitioner K. Krishnan, he joined the Indian military in 2010 and was posted in Kanabal district in Jammu & Kashmir. When he returned home on June 11, 2011, he came to know that his father’s younger brother, Chinnasamy, had died and his three elder brothers, including Govindasamy, were arrested.

When Krishnan moved bail applications for his brothers, he was shocked to know that his name was included in the FIR instead of Govindasamy, his brother. Subsequently, Govindasamy died and the local police declared Krishnan as dead and made the relevant entries in the records.

Alleging that his efforts to convince the officials went in vain, he moved a criminal miscellaneous petition. When the plea came up for hearing on Thursday, the Bench said, “If the claim of Krishnan is true, the charges against him will stand abated. If it is proved that the local police had made a false representation to the court, they have to face the legal consequences.”

But, if it is found that Krishnan’s claim is false, he would have to face legal consequences, the Bench added.
