Frame rules for Wakf Tribunal, court tells State

The Madras High Court has directed the State government to frame rules for constituting Wakf Tribunal as per the directions of the Supreme Court and notify them within three months.

The First Bench of Chief Justice S.K. Kaul and Justice R. Mahadevan also ordered the government to complete the process of selecting suitable members to the tribunal within two months after notifying the rules.

The Bench passed the directions on a PIL plea seeking a direction to the State government to constitute a three-member Wakf Tribunal to settle disputes relating to immovable property.

According to advocate A. Ilaya Perumal, the petitioner Madhu purchased a property measuring 2.686 square feet on Linghi Chetty Street through a sale deed dated February 5, 2007.

However, claiming ownership of the property by the Wakf Board, its chairman issued a notice to the petitioner on April 29, 2010.

Since the government has not constituted Wakf Tribunal to deal with such issues, the petitioner has approached the High Court.
