State to move SC against HC order on medical seat

The court had asked the govt. to allot a seat to visually impaired candidate

The wait of a visually impaired medical aspirant to join the course of his choice will have to continue, as the State government informed the Madurai Bench of the Madras High Court on Thursday that it will move the Supreme Court against the HC order directing it to allot a medical seat to him.

During the hearing of a contempt petition filed by the father of the candidate, the government informed a Division Bench of Justices K. Ravichandrabaabu and Senthilkumar Ramamoorthy that it will file a Special Leave Petition against a Division Bench order that upheld a Single Bench order. The case was adjourned to June 27.

M. Jabakar of Tirunelveli, in his petition, pointed out that his son J. Vibin had successfully cleared the public examination and NEET in 2018. He was ranked 285th in the all-India quota under the Special Category and was allotted a seat in the Pudukkottai Medical College, after online counselling.

However, his son was denied admission after the Madras Medical College issued a certificate for 90% visual impairment. The HC Bench had allowed the petition filed by the father in 2018 and subsequently dismissed the appeal preferred by the State government. The court had directed the State government to admit the candidate in the same or any other medical college.

Despite the court’s order, there was no response from the authorities concerned, the petitioner complained.
