A habeas corpus petition accusing former Dravida Munnetra Kazhagam (DMK) minister K.K.S.S.R.Ramachandran of abducting a person was dismissed as withdrawn by the Madras High Court bench here on Tuesday.
The petitioner, V.Guruvammal of Virudhunagar district, alleged that Mr.Ramachandran had abducted her brother-in-law J.M.Gose.
According to the petitioner, Mr.Ramachandran received Rs.32 lakh from Mr.Gose, a DMK functionary, to allot the Srivilliputhur constituency to him to contest in the 2011 Assembly election. But, Mr.Gose was neither given the seat nor the money back, she claimed.

Mr.Gose filed a complaint against Mr.Ramachandran at Aruppukottai Town police station and based on that an FIR was registered under Sections 406 and 420 of the Indian Penal Code, the petitioner said.
Meanwhile, on April 14, 2013, Mr.Ramachandran and two of his family members abducted Mr.Gose and took him to Bengaluru, where he was detained and tortured, she claimed.
Ms.Guruvammal further said the Virudhunagar Superintendent of Police failed to act on her complaint. Therefore, she moved the court.

On Tuesday, the Watrap police produced Mr.Gose before a division bench comprising Justices S.Rajeswaran and T.Mathivanan, following which the petitioner sought to withdraw her case. Mr.Ramachandran’s counsel P.Veerakathiravan argued that the false case was registered to defame his client.
The judges dismissed the case as withdrawn. However, in their judgment, the judges gave Mr.Ramachandran and his family members the liberty to initiate legal action against the petitioner and Mr.Gose if they had sufficient materials to assert that the case was fabricated against them.
