HC enhances woman’s monthly maintenance

Allowing a criminal revision petition, the Madurai Bench of Madras High Court ordered enhancement of monthly maintenance to a woman.

The court observed that the maintenance amount fixed by a lower court was on the lower side and enhanced the monthly maintenance amount from ₹3,000 to ₹4,500.

The court was hearing the petition filed by a woman from Sivaganga who sought enhancement of monthly maintenance awarded by a lower court in Sivaganga. Following differences with her husband, the petitioner said that she was living separately.

With no income to make ends meet she had filed a maintenance case before the family court.

The woman’s husband, a government employee, objected the plea to enhance the monthly maintenance. He said that lower court had fixed the amount taking his salary into account. He said that he was drawing a salary of ₹25,838 and his net salary was ₹10,807.

Hearing both the parties, Justice V. Parthiban observed, “it is to be borne in mind that whatever amount that goes towards deduction from the gross salary, accrues to the benefit of the person at a later point of time in the form of retirement benefits, therefore it cannot be said that the salary is a meagre amount”.
