HC directs SP to file counter in murder case

The Madurai Bench of Madras High Court on Friday directed the Deputy Superintendent of Police, Tirunelveli, not to file the final report in the murder case of a college student, belonging to a Scheduled Caste community, after his father complained of serious lapses in the investigation.

Justice G.R. Swaminathan directed the Superintendent of Police to file a counter in the case and adjourned the hearing. The court was hearing the petition filed by R. Usaikumar, the father of the murdered student Rajamani, who sought a transfer of the investigation of the case to CBCID.

It is said that during the funeral procession, a few caste Hindus threw flowers at the neighbourhood, where Scheduled Caste people were residing. A few people from the community, including Usaikumar’s son, questioned the behaviour of the caste Hindus leading to enmity between the groups. The petitioner’s son was murdered following the incident.

The petitioner complained that the investigating officer — the Deputy Superintendent of Police — did not know Tamil properly and could not understand their grievances. The statements were not recorded properly as per law, he complained.

The investigating officer was reliant on a police inspector and both of them colluded with each other and prevented him from appearing before a magistrate court for recording statements, the petitioner said.

He complained that the investigating officer is in a hurry to file the final report in the case.
