The Madras High Court Bench has directed the Judicial Magistrate in Melur to return the passport of Durai Dayanithi, son of DMK leader M. K. Alagiri. Mr. Durai had surrendered his passport at the JM court on December 14, 2012, following the conditions imposed on him by the High Court at the time of granting him anticipatory bail in the multi-crore illegal granite quarrying scam. Mr. Durai also filed an undertaking at the High Court assuring that he would inform the court of the schedule of his departure and arrival in advance.
Justice K. B. K. Vasuki said, “As a matter of fact, this Court has while granting anticipatory bail observed that no previous case is pending against the petitioner. The petitioner therein has good standing in society.” Taking into account the undertaking, the judge further said, “It is fit case wherein the condition can be modified as sought for by returning the passport to the petitioner.”
Modifying the conditions of the anticipatory bail, the judge directed the JM to return the passport to Mr Durai after he executes a bond of Rs 2 lakh. She directed Mr Durai to produce the passport whenever required by the court and to inform the court of his travel schedule not less than 10 days in advance to the court and the investigating officer. Mr. Durai filed the petition stating that he has business interests abroad, making it necessary to travel overseas frequently.
