Compensation for accident victim ordered

The Madras High Court bench here has directed the Managing Director of the Tamil Nadu State Transport Corporation (TNSTC), Kanyakumari, to pay Rs.22.27 lakh compensation to a road accident victim, who suffered 80 per cent disability.

A division bench comprising Justices N. Paul Vasanthakumar and P.Devadass passed the order while hearing the appeal filed by the TNSTC challenging an order of the Motor Accidents Claims Tribunal in Padmanabhapuram. The tribunal had ordered Rs.22.39 lakh compensation to S.Yobu, a motor vehicle mechanic, who sustained multiple injuries and fracture in right hand after being hit by a TNSTC bus in Kanyakumari district on April 24, 1997.

The medical certificate stated that Mr.Yobu suffered 60 per cent disability, whereas the tribunal, while awarding the compensation, held in its order that he suffered 100 per cent disability as he could not work as a mechanic anymore. Mr.Yobu was 31 years old and was employed in Oman when he met with the accident.

The tribunal also held that Mr.Yobu was on a visit to his hometown for his marriage.

He lost his marriage prospects. In their order, Justices Paul Vasanthakumar and Devadass noted that Mr.Yobu had sustained both functional and physical disability.
