Markfed division legal, says High Court

A Division Bench of Hyderabad High Court comprising Acting Chief Justice Dilip B Bhosale and Justice P. Naveen Rao made it clear that the division of Andhra Pradesh Marketing Federation Limited in May 2014 is legal, and that the Telangana Government has the power to appoint in-charge for the Telangana Marketing Federation.

The Bench was dismissing the pleas of several persons who challenged the bifurcation done in May 2014.

They contended that bifurcation of State was done in March 2014 and the May order of dividing the AP Marketing Federation is illegal. The Bench said that though the president gave assent to the bill in March 2014, the erstwhile State of Andhra Pradesh stood bifurcated into the State of Telangana and the State of Andhra Pradesh on and only from 2.6.2014.

Thus the division was declared valid. The petitioners contended that the elected persons are there and the affairs are to be run by them and not by those appointed by the government. The Bench said that the Telangana government has the powers in view of the provisions of the Act.
