Government clears prosecution of Akbaruddin Owaisi

The Telangana Government on Thursday gave permission to the police to prosecute the Majlis-e-Ittehadul Muslimeen MLA Akbaruddin Owaisi and the party’s Nirmal unit president Azeem-bin-Yahya for a hate speech that he delivered at a public meeting at Nirmal in Adilabad district on December 22, 2012.

Mr. Owaisi was arrested in two cases filed before courts in Adilabad and Nizamabad districts on January 8, 2013, and lodged in Adilabad district jail on charges of sedition and waging war against the nation. He was released on bail on February 16. Police had booked suo motu cases at Nirmal in Adilabad and Nizamabad against the MLA after he allegedly used inflammatory, derogatory language against BJP and Prime Minister Narendra Modi.

However, the police had failed to file charge sheet in the cases for nearly three years till an application under Right to Information seeking the status was made in September last year.

Subsequently, the charge sheet was filed in a court in Adilabad and the same was informed to the High Court. The court ordered police to expedite the process of filing charge sheet.

The Director General of Police had, meanwhile on October 10 addressed a letter to the Government seeking permission to prosecute the accused under Sections 120-B, 121, 124-A, 153-A, 295-A, 505 and 188 of the IPC.

The Law Department said the Government was satisfied that the accused should be tried for offences.
