Wife of Defence Ministry officer asked to vacate accomodation

A Delhi court has directed the widow of a former officer of the Ministry of Defence to vacate a government accommodation in Andrews Ganj in south Delhi.

The accommodation had been allotted to her late husband. The estate officer had asked her to vacate it in 2015.

However, she had challenged the eviction order in the court of Additional District Judge Gurvinder Pal Singh.

“It is a fact that since the office of employment of [the widow] finds no mention in the list of offices eligible for allotment of General Pool Residential Accommodation in Delhi, she is not entitled for regularisation of the same accommodation in her name which was (earlier) allotted to her deceased husband during his lifetime, as director in the Ministry of Defence,” the judge said.

“Said public premises was not vacated within period of one year of demise of the allottee or even after expiry of the extended period of one year i.e. after two years of death of the allottee by the family members of the deceased allottee including the appellant,” the court said.
