Students’ union poll faces legal block: Jamia

Responding to demands by students of Jamia Millia Islamia (JMI) for announcement of dates for students’ union election, the administration of JMI said that it has found from court records that until the students who approached the Delhi High Court in 2012 withdraw their petition, the poll cannot be held.

In a statement, JMI said that it had obtained documents related to the writ petition titled “Hamidur Rahman vs. JMI” from the High Court that was filed in 2012 asking for a direction to the university respondent to hold and conduct the union election.

“A group of nine students have intervened in the writ petition and have opposed any system of election in JMI in February 2012, and the administration had responded in April 2012 after which the High Court in July 2012 had given an opportunity to the petitioner to file his response. The High Court in November 2012 had given another opportunity to file the response, but the petitioner has failed to do so,” read the statement by the university.

The JMI administration said that the legal hurdle can only be solved in the court by withdrawing the petition as well as the intervention of the group of students/applicants. “Since the matter is sub judice, any interim action on part of JMI will amount to contempt of court,” said the university.

It added that the university was ready to consider holding students’ union election depending on the outcome of the case.
