Real estate company asked to pay ₹52 lakh to flat buyer

For failing to deliver possession of apartment within stipulated time

The National Consumer Disputes Redressal Commission (NCDRC) has directed Unitech developers to compensate a flat buyer by paying over ₹52 lakh for failing to deliver possession of the residential apartment within the stipulated time.

Noting that the developers had failed to deliver possession of the flat within 27 months, as promised, the NCDRC said, “The documents filed by the complainant prove allotment made to the complainant as well as payment made to the [developers]. Since the possession was not delivered to them within the stipulated time period in the terms and conditions of the allotment, they are entitled to seek refund of the amount paid.”

Directing the developers to compensate the flat buyer, the apex consumer forum said, “The [developers] shall refund the entire principal amount of ₹52,36,587 to the complainants... the [developers] shall also pay a sum of ₹25,000 as the cost of litigation to the complainants.”

The directions came when the consumer forum was hearing a complaint moved by a city resident who alleged that a residential apartment in a Greater Noida project, Unitech Verve, was booked by the complainant.

Pending since 2010

Further, it was alleged that the apartment which was to be delivered by April 2010 has still not been handed over to the complainant.
