Minor’s testimony pins father

Relying on the testimony of a 12-year-old boy, a Delhi court has sentenced his father to six years of rigorous imprisonment for subjecting his wife to cruelty, leading to her suicide at Sarai Rohilla in West Delhi in 2012.

The woman had consumed pesticide. The doctor’s report said that the injury marks on her body were of immediately before her death.

According to the prosecution, the accused husband, Manohar Lal, used to beat his wife.

He had also beaten her on the day of the incident.

The court was all praise for the boy for his testimony who was nine-year-old when the incident occurred. He reiterated his facts about the case thrice — before the police, in his statement before a Metropolitan Magistrate and finally in his evidence in the trial of the case.

Brother, sisters and mother of the victim also corroborated the testimony of the boy who had turned 12 when he recorded his evidence in the court.

“There was no reason for the complainant Aman to depose so strongly against his own father.

“Rather, it was extremely courageous of this boy to testify against his sole living parent not once but thrice after the death of his mother,” Additional Sessions Judge Hemani Malhotra said about the testimony of the boy.

Rejecting the plea for mercy by the accused, the Judge said: “In view of the fact that the conduct of the convict drove the deceased Santosh to take the extreme step of committing suicide, thereby, depriving his three minor children of the love and affection of their mother (deceased), no lenient view can be taken.

Accordingly, convict Manohar Lal is sentenced to undergo rigorous imprisonment for a period of six years.”
