Four other accused held guilty of voluntarily causing hurt

A Delhi court has convicted a man for murdering one of his neighbours in revenge of remarks the victim had made against his wife in north-east Delhi’s Gokulpuri in 2013.

Additional Sessions Judge Raghubir convicted accused Vipul Kumar on the basis of the eyewitness account of the victim’s brother. The police had also lodged the complaint on the statement of the witness.

Other accused

There were four more accused in the case. They were held guilty of voluntarily causing hurt.

“The detailed deposition of eyewitness Satish and rest prosecution witnesses is/are clear enough in establishing the presence and complicity of the accused persons there at the spot on the fateful day and time. Even in the cross case between the parties the facts had come on record so as to clearly construe that each and every person so impleaded as accused in the present case, including accused Vipul Kumar was very much present and involved in the alleged commission of the role respectively attributed to them by way of the complaint,’’ the judgment said.

‘Hint of motive’

“The complaint also gives a hint/indication of motive as to why the accused persons in general and accused Vipul in particular were having intention to cause injuries to said Sushil [since deceased] as some incident of confrontation/grappling had taken place on the very day. Initially, the police had proceeded against the involved persons under Section 107/151 CrPC and perusal of the material on record in that context also makes it clear that accused Vipul was having some grudge against deceased Sushil as the deceased had made some comments/remarks concerning the wife of accused Vipul,’’ the judgment also said

“On the basis of the appreciation made herein above, it is crystal clear that the prosecution has proved beyond reasonable doubts that it was accused Vipul Kumar who had intentionally caused the fatal blow on Sushil and he is thus liable to be held guilty for the offence punishable under Section 302 IPC,’’ the judge said.

“As far as the rest of the accused persons are concerned, the charge proved as against them is only that of under Section 323 IPC for which they are accordingly held guilty. This way, accused Vipul is found and held guilty for the offence under Section 302 IPC and is convicted thereof. The rest accused persons namely Kumar Pal, Sanjay, Prakash Wati and Dharamwati are found and held guilty for the offence punishable under Section 323 IPC and are convicted accordingly,’’ he further
