Court says complainant was in love

A Delhi court has acquitted a man of abduction and rape charges, saying that the victim had filed a complaint against him in annoyance after his mother rejected her proposal to marry him on the ground that the couple belonged to different castes.

Caste issue

Additional Sessions Judge Sanjiv Jain acquitted the accused stating that the victim was in love with him and wanted to marry him but her proposal was rejected by his mother as she is from a different caste.

“The woman and the accused were friends. They loved each other and wanted to marry. Owing to caste differences, the accused refused to marry the woman since his mother did not want him to marry the prosecutrix. She got annoyed and made the complaint,” Mr. Jain said in his judgement.

The court said the testimony of the victim was categoric to the fact that the accused never established physical relations with her forcibly, as alleged in the police complaint. According to the prosecution, the woman had in her complaint alleged that the accused had abducted and raped her at his house on March 18, 2014.

Cross-examination

However, during her examination and cross-examination, she evidenced contrary to her allegations in the complaint and denied the abduction and rape charges. The court also dispensed with recording of statement of the accused after the prosecution failed to lead any incriminating evidence against him.
