Court seeks Tytler’s reply on polygraph test

Told to give ‘unambiguous’ answer

Stating that the CBI plea for a polygraph test on Congress leader Jagdish Tytler and alleged arms dealer Abhisek Verma in a 1984 anti-Sikh riots case is maintainable, a court here on Tuesday directed both to give an unambiguous answer to the plea.

“Both the non-applicants [Tytler and Verma] are directed to file affidavits clearly specifying that they have understood the nature of the test that is sought to be conducted on them and giving a clear and unambiguous consent/no consent for participating in the polygraph test,” Additional Chief Metropolitan Magistrate Shivali Sharma said in the order.

Conditions welcome

The court also said that if they wanted to put conditions for undergoing the test, they should appear in person on May 22 for clarification.

Counsel opposes plea

Opposing the plea, the counsel for Mr. Tytler argued that it had been filed with an intent to embarrass him. The CBI had sought the court’s permission to conduct the test on them, stating that it was needed for the purpose of further investigation.

Rejecting the third clean-chit to Mr. Tytler by the CBI in the case, the court had in December 2015 directed the agency to further probe the allegations against him.

Lakhwinder Kaur is the complainant in the case. She is the wife of a man who was killed along with two others by a mob at Gurdwara Pul Bangas in north Delhi during the riots. She has accused Mr. Tytler of inciting the mob that allegedly attacked the gurdwara.
