A Delhi court has acquitted a man in a sexual assault case as the victim said in her evidence in the trial that he established physical relations with her consent.

She also evidenced that she lodged the complaint against him and reiterated the allegations in her statement before a Metropolitan Magistrate under Section 164 of CrPC in a fit of anger.

In her complaint to the Kotla Mubarakpur police, the victim said that the accused, son of her maternal uncle, sexually assaulted her at her rented accommodation after offering her a sedative-laced drink.
Pretext of marriage
She alleged that the accused used to establish physical relations with her on the pretext of marrying her.

When she got pregnant, the accused forced her to drink some medicine resulting in miscarriage.
She had requested him several times to marry her but he refused, she further alleged.
In the evidence, she denied all the allegations.
“Accused used to visit their house. An affair started following which they made consensual physical relations at her residence. She was interested in marrying the accused. However, she realised it later that it was not possible as the accused was the son of her maternal uncle,” the victim said in her evidence.
Denied all charges
“The prosecutrix had denied all the allegations of the accused visiting her house frequently, offering her sedative-laced drink and establishing forcible physical relations with her in her unconscious state or establishing physical relations with her on false assurance of marriage stating that the physical relations were established with her consent,” Additional Sessions Judge Renu Bhatnagar said in her judgment.
Hence, the accused is acquitted for the offences under Section 328/376 (2)(f) /417/376(2)(n)/313 IPC for which he has been charged, the judge further said acquitting the accused.
