Bawana fire victim wants accused’s bail cancelled

‘Accused has not paid solatium in time’

One of the injured victims of the Bawana fire tragedy here has moved a Delhi court seeking cancellation of bail of an accused on the grounds of non payment of first instalment of the ₹34 lakh compensation to the victims’ families within stipulated time period.

Seventeen persons were killed in the fire on January 20 this year.

Moving the application through his lawyer Rishipal, victim Shamshudeen submitted that accused Ashish Jain was granted bail following his undertaking that he would pay a compensation of ₹34 lakh — ₹2 lakh each to the families of 17 victims — of which ₹17 lakh would be deposited within 45 days of the bail order. The time period ended on October 22, with the accused only depositing ₹10 lakh of the first instalment. The part payment of this instalment was also made eight days after the deadline, the victim’s counsel further submitted.

Taking the application on record, District and Sessions Judge Sanjeev Kumar issued notices to the Delhi government and the accused, seeking their replies by November 14.

The Crime Branch had filed a charge sheet in the matter in March in the court of Chief Metropolitan Magistrate of the Rohini courts under various Sections of the Indian Penal Code, the Explosives Act, the Poisons Act and the Juvenile Justice (Care and Protection of Children) Act. Mr. Jain did not figure in the main charge sheet. He was charge-sheeted later in a supplementary probe report.
