The Delhi High Court on Wednesday issued notices to the Union Government and the Kendriya Vidyalaya Sangathan (KVS) on a public interest litigation seeking a stay on charging tuition fee from students of Class I to VIII studying in Kendriya Vidyalayas.
Issuing the notices, a Division Bench of Justice Darmar Murugesan and Justice Jayant Nath asked the respondents to file replies to the petition by May 15, the next date of hearing.
The charging of tuition fee from these students was violation of Articles 21 and 21A of the Constitution and the Right to Education Act which provided for free education to students of Class I to VIII of these schools.

Accepting the notices, counsel for the KVS submitted that after implementation of the Right to Education Act, tuition fee had not been charged from these students. He further submitted that, however, certain amounts had been levied on them for computer classes and other services.
The petitioner, Social Jurist, through its lawyer Ashok Agarwal, alleged that the Kendriya Vidyalayas were charging fees under various heads from these students.
