HC notice to police on Vikas Yadav’s application

The Delhi High Court on Thursday issued a notice to the Delhi police on an application by Vikas Yadav, serving life imprisonment in the Nitish Katara murder case, seeking interim bail for three months to participate in the marriage ceremony of his sister, Bharti Yadav, on November 1.

Issuing the notice, a Division Bench of the Court comprising Justice Anil Kumar and Justice Vipin Sanghi asked the city police to file a reply to the application by October 20.

Earlier counsel for Vikas submitted that his client’s presence at the marriage ceremony of Bharti was necessary to perform certain rituals as the elder brother.

Arguing for grant of the plea, he further submitted that his client hoped to get relief from the Court as it had earlier permitted convicts of sensational murder cases to participate in family functions.

The Court had earlier ordered release on interim bail of R.K. Sharma, dismissed senior IPS officer of the Haryana police serving life imprisonment in the Sivani Bhatnagar murder case, to participate in the marriage ceremony of his daughter.

Bharti was a key witness in the case.

Vikas Yadav and his cousin Vishal Yadav are at present serving life term in the case. A trial court had last year sentenced the two to life imprisonment, holding them guilty of kidnapping and later killing Nitish Katara because they were opposed to Bharti’s affair with him.

The High Court is seized of Vikas’s appeal against the trial court judgment.
