Life convicts' bail can be cancelled, says Bench

MADURAI: The Madurai Bench of the Madras High Court on Friday held that a bail granted to life convicts by the High Court pending appeal against the trial court judgement could be cancelled for misusing the liberty and indulging in criminal activities during the bail period.

A Division Bench comprising Justice M. Chockalingam and Justice A. Selvam gave the ruling while allowing a petition moved by the State to cancel the bail granted to a duo, R. Palani and P. Bala, convicted by the Sivaganga Additional Sessions Court for murdering a Dravida Munnetra Kazhagam youth wing leader Russo on November 11, 1998.

The Division Bench refused to accept the contention of the convicts' counsel that the bail granted by the High court after considering the merits of the case and particularly after the convicts had served more than four years in jail cannot be cancelled merely because they were subsequently accused of having involved in a robbery. Instead the Judges agreed with the State Public Prosecutor Raja Elango that social order should be given paramount importance than individual liberty. The High Court had granted bail to the convicts on November 30, 2005, while admitting an appeal against the Sessions court judgement.
