HC order on treatment to convicts

KOCHI Oct 22. A Division Bench of the Kerala High Court today ordered that the five CPI(M) activists who had been sentenced in the Jayakrishnan murder case could not be treated as condemned prisoners until a final judgment was passed by the High Court.

The Bench, comprising Justice J. B. Koshy and Justice K. Thankappan, observed that they could only be treated as persons sentenced to life imprisonment (punishment for murder as provided under Section 302 of the Indian Penal Code).

The court also ruled that the jail authorities were free to take appropriate steps for ensuring the safety of the convicts.

The convicts are Acharambath Pradeepan (28), Kunhipunathil Sundaran (36), Nallaveettil Shaji (26), Parambath Chathampally Dinesh Babu (25), K.K. Anil Kumar (24), the first, second, third, fourth and sixth accused in the case.

The fifth accused, Paramban Rajan (31), had been acquitted by the judge on August 21.

The seventh accused, Palayamkandy Sajeevan, had been killed in a train accident.
