Supreme Court notice to Kerala on Mullaperiyar issue

New Delhi: The Supreme Court on Monday sought response from the Kerala Government and others on an application seeking implementation of its order allowing an increase in the water level of the Mullaperiyar dam to 142 feet.

A Bench of Justices C.K. Thakker and Altamas Kabir directed the Kerala Government and the Centre, besides Tamil Nadu, to file their replies within six weeks on the interlocutory application moved by some Tamil Nadu farmers, who also sought posting of CISF personnel at the dam site to prevent any untoward incident.

The application by the Periyar Vaigai Single Crop Cultivating Agriculturist Society stated that though the court on February 27, 2006, had directed Kerala to allow raising of the water level, the State chose to circumvent the order by bringing in a special legislation.

The Kerala Irrigation and Water Conservation (Amendment) Bill 2006, sought to retain the water level at 136 feet, thus overruling the court direction.

The application also accused Kerala of deploying large number of its police personnel at the site to take control of the dam and prevent Tamil Nadu from carrying out repairs. PTI
