CHENNAI: The Madras High Court has granted interim stay of proceedings before a magistrate court here in a motor vehicle accident case, in which it was alleged that wrong particulars were given in the charge sheet.

Justice K.N.Basha admitted a petition, which stated that if further proceedings were allowed to go on, based on the charge sheet framed with wrong details, they would affect the petitioners’ claim before the Motor Accidents Claims Tribunal. The government advocate took notice.

In their petition, filed by counsel G.Devi and V.S.Suresh, petitioners K.P.Dinesh Babu of Medavakkam and L.R.Baskar of West K.K.Nagar said they were travelling on a two wheeler in Ambattur Estate in December 2007. They had stopped to seek direction when an MTC bus hit their vehicle.

They suffered severe head injuries and serious injuries on other parts of the body. They were treated as in-patients for about 20 days. Later, too, treatment continued.

The Poonamallee Highways police station, Traffic Investigation, filed a charge sheet before the Judicial Magistrate, Ambattur. Apart from giving the year of the accident as 2008, instead of 2007, the registration number of the vehicle and its make had been wrongly mentioned.

The registration number recorded was that of the vehicle which was being driven by K.P.Dilli Ganesh, Mr.Dinesh Babu’s brother, who was also with the petitioners. Further, the police had stated that the petitioners suffered severe injuries only on the shoulder. The FIR and sketch carried the correct details.

The petitioners prayed the court to call for the records and quash the charge sheet pending before the magistrate court.
