High Court turns down KSHB demand

KOCHI: The Kerala High Court has turned down a demand made by the Kerala State Housing Board (KSHB) to two allottees of its flats for an additional amount towards the cost of the flat.

Justice M. Ramachandran quashed the demand as he found that that the Board had not been able to establish that it was legal and reasonable and authorised by the agreements.

However, the court granted the Board liberty to advise the petitioners about the actual cost that would have to be shared by them, including the interest. The directions came on a petition filed by Rajee and another owner of the flat constructed by the Board at Vasanth Nagar at Palarivattom.

According to the petitioners, the Board had not taken them into confidence before making the demand. The Court observed that the Board had not been able to substantiate its stand that the demand was authorised and on permissible grounds.
