Writ petition on flag-hoisting dismissed

Dharwad: The High Court Circuit Bench in Dharwad on Monday has dismissed a writ petition filed by Anjuman-e-Islam questioning the State Government’s decision to ask the Hubli-Dharwad Municipal Corporation (HDMC) Commissioner to hoist the national flag at the Idgah Maidan here as part of the Republic Day celebrations.

A single-judge bench comprising Justice H.G. Ramesh dismissed the writ petition after an argument by advocate F.V. Patil representing Anjuman-e-Islam. Mr. Patil argued that the State Government did not have the authority to pass such an order and appealed to the court to allow Anjuman-e-Islam to hoist the national flag. On behalf of the State Government, advocate C.S. Patil said that as per the Supreme Court verdict, HDMC was the owner of Idgah Maidan and Anjuman-e-islam had the licence to hold prayers twice a year at the Maidan. Since the land belonged to the corporation, the Government was deciding authority.
