Removal order of SKU V-C set aside

Justice Nooty Ramamohana Rao of the High Court on Thursday set aside the orders for removal of Kusuma Kumari, Vice-Chancellor of Sri Krishnadevaraya University (SKU), Anantapur, on the ground that she was not put on notice.

However, the court advised her to stay away from work till her explanation was considered.

The judge also said that the in-charge Vice-Chancellor will continue to discharge the functions as per the arrangement made by the government.

Passed in a hurry

The judge was dealing with a writ petition filed by Prof. Kumari who was removed from office after a retired judge of the High Court, A. Hanumanthu, submitted a report. She alleged that the order of removal was passed in a hurry and violated the basic principles of service jurisprudence.

Justice Ramamohana Rao called for records and found that she was not put on notice. He held that the principles of natural justice were part of the statute and set aside the order of termination.

He, however, said the termination order must be treated as a show-cause notice to submit her explanation on which the authorities have to pass final orders within four weeks.

The judge found that there was no provision for keeping a person occupying the high-sensitive post of SKU Vice-Chancellor under suspension.

While advising her to stay away from work, the judge said she would be eligible for all the perks, including accommodation.
