CBI chargesheets faulted

The special court trying the Satyam fraud accused was informed by the counsel for former managing director of the company, B. Rama Raju, that the three chargesheets filed by the Central Bureau of Investigation (CBI) in the case were a generalised treatise of the purported crime.

The counsel, K. Ravinder Reddy, averred that the chargesheets when read together did not indicate which of the accused had done what wrong. There was also no mention of the time of the crime. He feared that the consequences of the defective chargesheets could lead to serious prejudice to the accused.

Mr. Reddy said the role of his client was not indicated in the chargesheets. They only stated that he was part of a conspiracy along with others. But, the agreement to commit an illegal act which had to be established in law was missing in them.

The CBI failed to produce any material to attribute the offence of conspiracy to the accused. In the absence of presumptive ingredients of offence, Mr. Reddy pleaded that no offence could be made out against his client. More so, there was nothing to warrant framing of charge for conspiracy.

He blamed the CBI for making a self-serving statement that Mr. Rama Raju created and destroyed fixed deposit receipts. The charge was unsubstantiated.

Counsel for another accused, V.S. Prabhakar Gupta, former global head of the company's internal audit team, said his client was falsely implicated in the crime on the ground that he did not inform anomalies in certain invoices to the audit committee. In fact, he was denied access to the invoices.

Mr. G. Ramakrishna, former vice-president of the company, sought four days to argue his case in person. He said he wanted to go into each document touching his role. The magistrate scheduled his argument on Tuesday but insisted that he need not go into all details because the court was not concerned at this stage whether the documents were true or false.
