Court summons D. P. Yadav in Katara murder case

Bid to find out London whereabouts of his daughter Bharti Yadav, a key witness in the case

NEW DELHI: A Delhi court on Tuesday summoned former Member of Parliament D. P. Yadav to assist it in finding out the whereabouts of his daughter Bharti Yadav, a key witness in the Nitish Katara murder case.

Issuing a notice to Mr. Yadav, Additional Sessions Judge Ravinder Kaur directed him to be present in person in the court on May 22.

Ms. Kaur also rejected a request by defence counsel to adjourn hearing of the case for two days.

"Since the whereabouts of Ms. Bharti are not known, her address should be found out first and then summons issued to her,'' said Ms. Kaur in her order. "It is pertinent to mention that Ms. Bharti's whereabouts are not known now and that she has left her last known address in the United Kingdom.''

The order also noted that the validity of her visa would expire on November 30 this year and therefore she could neither be deported nor extradited to India thereafter.

What would be her status after November 30 was still to be confirmed by the authorities concerned, the order stated.

At the last hearing of the case here earlier this month on May 12, the Union Home Ministry had informed the court that Ms. Bharti was not available at the address at which the court had issued a non-bailable warrant against her.

Enrolled for a course

Immediately after the sensational murder of her boyfriend Nitish Katara in February 2001 Ms. Bharti had moved to London and purportedly enrolled herself for a course at a professional institute there.

However, the prosecution charge against her has been that she shifted to London to avoid recording of her statement in the murder case.

The prosecution's allegation against Bharti Yadav's brother Vikas Yadav and his cousin Vishal Yadav is that they had abducted and later killed young Nitish Katara, son of a former senior Indian Administrative Service officer here, because they were opposed to Nitish having an affair with Ms. Bharti.
