Spectrum probe

The investigation into the 2G spectrum scam is moving in the right direction. The CBI Special Court has rejected the bail application of DMK Rajya Sabha member Kanimozhi, citing the gravity of the allegations and the character of evidence.

But one cannot help feeling that action against the high and mighty is taken only because the probe is being monitored by the Supreme Court.

While the law takes its course to bring the accused to justice, the UPA government should recover the enormous loss incurred in the allocation of 2G spectrum.

The argument that a woman should not be arrested (citing her motherhood and other reasons) in a criminal case is unacceptable. Just as women are expected to be treated on a par with men in matters of education, employment, wages, etc., they should be dealt with in the same way as men under the law.

Courts should not follow the principle that in every cognisable and “non-bailable” offence, the offender should be arrested. The power to arrest is different from the need to arrest. Unless a person is required for custodial interrogation, arrest is not necessary. If investigations can be completed without arrest and the person concerned extends all cooperation, he or she should not be arrested. Ms Kanimozhi never absconded or disobeyed court orders.
