Plea for FIR on Jaya’s death

An advocate from Manjakuppam in Cuddalore district has moved the Madras High Court challenging the refusal of a Metropolitan Magistrate here to direct Chennai city police to register a case under Section 174 (inquiry into suspicious deaths) of the Code of Criminal Procedure with respect to the death of former Chief Minister Jayalalithaa.

The revision petitioner A.K. Velan claimed that the XIV Metropolitan Magistrate at Egmore had dismissed his petition on June 27 on the ground of lack of locus standi though Section 156(3) of Code of Criminal Procedure requires the police to register a First Information Report on a complaint made by any person with respect to the commission of an offence.

When the revision petition came before Justice S. Vimala on Thursday, a government counsel brought it to the notice of the court that a similar revision petition filed by another litigant was dismissed by the High Court recently. Hence, the judge ordered production of the dismissal order and adjourned further hearing on the case to Monday.
