Seeks explanation from Health Secretary, Director of Medical Services

The Madras High Court on Thursday took up suo motu a writ petition on the basis of news reports of a 23-year-old pregnant woman having been transfused with HIV-positive blood at a government hospital in Sattur, Virudhunagar district, on December 3 to treat anaemia.

The blood had been donated by a youngster at the Sivakasi government hospital in the same district.

A Bench of Justices S. Vaidyanathan and P.T. Asha agreed with an advocate, who brought the issue to the notice of the court, that it was a serious issue that required immediate attention of the authorities concerned. It impleaded the Health Secretary, Director of Medical Services and Joint Director of Health Services in Virudhunagar district as respondents to the petition.

It directed Government Pleader (in-charge) V. Jayaprakash Narayanan to take the notices on behalf of all the respondents and submit their replies by January 3. Additional Advocate General P.H. Arvindh Pandian was asked to ensure that government officials took serious note of the issue and file a status report by the next hearing listing out the action taken so far.

Procedures violated

According to reports that emerged, the 19-year-old donor was not aware of his HIV positive status when he donated blood for one of his relatives at the Sivakasi hospital on November 30. Though it was mandatory to test donated blood for HIV, inform the donor if it turns out to be positive and not use it, none of the procedures was supposedly followed.

The youth learnt about his HIV as well as Hepatitis B status many days later while undergoing a medical check-up for taking up a job abroad. He rushed to the Sivakasi hospital on December 10 to find out the status of the blood that was donated by him a week ago, but by then, the blood had been transferred from Sivakasi to the Sattur hospital and transfused to the pregnant woman.

The episode came to light only on Tuesday after an internal probe by a team of doctors. Immediately, the government terminated the services of three hospital employees, ordered a high-level inquiry and shifted the victim to the Government Rajaji Hospital in Madurai
