A fresh plea was made to implead R. Indira Kumari, former minister, in a case registered by CB CID police in connection with alleged irregularities in the Social Welfare Department during 1994-96.
Ms. Indira Kumari was the Social Welfare Minister in the AIADMK regime during 1991-96 and joined DMK in 2006. The CB CID police registered the case against 33 persons, including Ms. Indira Kumari, during the DMK regime in 1997 for the alleged irregularity in procurement of ‘sundal’ (gram) under noon meal programme during 1994-1996.
J. Murugesan and J. Umapathy, accused in the case, filed a memo before the Special Court for cases of Directorate of Vigilance and Anti-Corruption (DVAC). When the case came up for hearing before Special Judge G. Vijayalakshmi on Monday, a notice was taken by a Special Public Prosecutor.
In the memo, they pointed out that originally CB CID police opened the first information report against 33 persons, including Ms. Indira Kumari. They also alleged, “After the investigation, the police filed the charge sheet against 13 persons in 2009, conveniently leaving the name of the main accused, Indira Kumari.”
The complainant (the police) had not given any reason for dropping the former minister who took all decisions, and most of the witnesses would speak in that regard, the petitioners added.
Relying on a judgement of Supreme Court, the petitioners contended that the special court had powers to implead a person who was named in FIR but subsequently left out in the charge sheet.
The court adjourned the matter for further hearing on December 12.
