An advocate said in his representation that there was an inordinate delay on the part of authorities in announcing by-election

The Tamil Nadu Chief Secretary, the Chief Electoral Officer and the Chief Election Commissioner have been urged to declare the Srirangam Assembly seat vacant after the disqualification of the former Chief Minister, Jayalalithaa, because of her conviction in the disproportionate assets case.

In his representation to the Chief Secretary and others, Supreme Court advocate G.S. Mani of the Vijayakant-led Desiya Murpokku Dravida Kazhagam said there was inordinate delay on the part of the authorities in declaring the constituency vacant and announcing a by-election.

He said that on September 27, a special court in Bangalore sentenced Ms. Jayalalithaa to four-year imprisonment and imposed a fine of Rs. 100 crore on her, and she attracted the disqualification from the date of judgment under the law laid down by the Supreme Court in the Lily Thomas case. However, the authorities were yet to declare the seat vacant and take steps to hold a by-election.

Though the Supreme Court granted bail to the four convicts (Sasikala Natarajan, V. Sudhakaran and J. Elavarasi, besides Ms. Jayalalithaa), their conviction was not overturned. Hence, the authorities, including the Director of Vigilance and Anti-Corruption, were bound to comply with the special court’s order on the recovery of Rs. 100 crore in fine, but no steps had been taken so far, he said.

As an aggrieved citizen, Mr. Mani said, he would move court for a mandamus to the authorities and initiate contempt proceedings against them for their failure to comply with the order.
