HC says petitioner had no connection with deaths of crew

The Madras High Court has quashed a case booked against an individual in connection with the death of six crew members of MT Pratibha Cauvery because they were transported along with 16 others in a faulty life boat when cyclonic storm Nilam hit the shores on October 30, 2012.

Allowing a petition filed by Captain Sunil Kumar Rai in 2014, Justice M.S. Ramesh quashed all proceedings pending against him before a Metropolitan Magistrate court at Saidapet here and made it clear that the prosecution could continue with respect to the other accused in the case.

The judge held that the petitioner, serving as Designated Person Ashore at the relevant point of time, had no connection with the deaths and therefore he need not be made to undergo the ordeal of trial.
