A writ petition has been filed in the Madras High Court Bench here seeking to restrain the Election Commission from announcing the election results of Radhapuram Assembly constituency contested by Congress candidate P. Veldurai whose 2006 election from Cheranmahadevi constituency was set aside by the Supreme Court recently.
M.G. Raja Beemarao of Ambedkar People's Movement had filed the petition claiming that a candidate who was found to be disqualified to contest in one election must not be allowed to contest in the subsequent one. The petitioner also sought for a direction to conduct re-election in Radhapuram constituency besides initiating appropriate action against Mr. Veldurai.
According to court sources, the writ petition would be transferred to the Principal Seat of the High Court in Chennai in consonance with a notification issued by the Registrar General last month that all cases related to the 2011 Assembly elections, filed either in the Principal Seat or in the Madurai Bench, must be posted only before the First Bench comprising the Chief Justice M. Yusuf Eqbal.
However, the court officials were clueless as to how the matter could be posted before the Chief Justice as the court was on summer vacation.
