Appeal against pension to bus conductor dismissed

The Madras High Court has dismissed an appeal filed by a State Transport Corporation challenging a single Judge's order directing payment of pension to a bus conductor who got voluntary retirement.

Earlier, N. Krishnaswamy of Tirupur, who had put in 20 years in the Tamil Nadu State Transport Corporation, Kovai Division –II, Erode, and obtained voluntary retirement, moved the High Court seeking a direction to the Tamil Nadu State Transport Corporation Employees Pension Fund Trust to sanction and disburse pension to him.

A single Judge allowed the plea in April last year. Hence, the present appeal by the transport corporation.

In its judgment, the First Bench consisting of Chief Justice M.Y. Eqbal and Justice T.S. Sivagnanam said that admittedly, Mr. Krishnaswamy joined the transport corporation in 1977 and got voluntary retirement in 2000. Thereby, he had completed 20 years of continuous service. In that view of the matter, the single Judge rightly relied upon an earlier judgment of the High Court and allowed the writ petition.

The Bench said it did not find any reason to differ with the findings of the single Judge.
