PIL seeks CBI probe into ‘irregularities’ in filling up discretionary quota in Anna University

A public interest litigation petition has been filed in the Madras High Court seeking a direction to the CBI to probe the ‘irregularities’ in filling up the seats under the government’s discretionary quota in Anna University from 1999 to 2006.

The central agency should also go into the activities of two Additional Directors-Generals of Police who had got engineering seats for their children under the government’s discretionary quota in the university, the petitioner said.

In his petition, filed by counsel M.Radhakrishnan, the petitioner Prof.Praba.Kalvimani of Tindivanam, Villupuram district, said that the daughter of one officer who had secured 229.44 marks out of 300, which was less than the minimum cut off marks applicable to ST candidates (244.11), had been given a seat in Computer Science and Engineering branch in the College of Engineering, Guindy, in the academic year 2004-2005.

The son of the other police officer had obtained 188.31 out of 300 which was less than the cut-off marks for ST candidates (246.92) was allotted a seat in the Electronics and Communication Engineering branch in the same institution in 2005-2006.

The petitioner said he made a representation dated November 3, 2007 to the authorities seeking a probe into the matter relating to the admissions by the CBI. Since no response was forthcoming, he made an application dated February 13, 2008 under the RTI Act asking for the details of the action taken on his representation. He received a reply from the Tamil Nadu Government to the effect that the Home (SC) Department was exempted from the purview of the Act and consequently, it was not possible for the government to give the information sought.

When it came up before a Division Bench comprising the Chief Justice H.L.Gokhale and D.Murugesan, the court orally sought from the government details relating to the enquiry following the petitioner’s representation and asked whether the outcome was communicated to the petitioner. The matter has been adjourned to October 12.
