MCI notification suffers from lack of jurisdiction: State

The Tamil Nadu government on Thursday submitted before the Madras High Court that the Medical Council of India's notification of December last year, prescribing a national-level eligibility-cum-entrance test for admission to MBBS and postgraduate medical education, suffered from a lack of jurisdiction.

In his counter to a petition filed by DD Medical College and DD Hospital, Kunnavalam, Tiruvallur district, which challenged the validity and legality of the notification, Health Secretary V.K. Subburaj stated that the Tamil Nadu government had already enacted the Tamil Nadu Admission in Professional Educational Institution Act.

The validity of the legislation was upheld by the High Court. On a petition by the State government, the High Court had granted stay of the operation of the notification.
