Court dismisses plea to quash Tahsildar’s order

The Madras High Court has dismissed a petition seeking to quash an order of the Special Tahsildar, Adi-Dravidar Welfare, Tiruppur, under the Tamil Nadu Land Acquisition Act for Harijan welfare scheme. By his order, the Special Tahsildar sought to acquire 0.10 acre belonging to the petitioners. In his order on the petitions by V. Krishnasamy Gounder and S. Revathi Kumari, Justice M. Venugopal observed that if the land was required for public purpose and if the notification was issued in accordance with law, the High Court would not substitute its opinion for the opinion of the competent authority to enquire into the wisdom of the authorities in this regard. The respondents had acted in accordance with law and followed all the procedural formalities. As the land in question had been acquired for providing a pathway to the burial ground, the interest of the petitioners should necessarily yield to public interest, the judge said.
