The Supreme Court will hear on Wednesday a public interest petition seeking its intervention to restrain the government from clearing the names of retired judges of the Supreme Court and high courts to any posts “without the consultation and concurrence of the Chief Justice of India or the Chief Justices of the high courts.”
The matter is scheduled to be heard before a Bench led by Chief Justice of India H.L. Dattu. The PIL plea, filed by a Bangalore-based Ph.D. student, Muhammed Ali, said this restraint was in compliance with the recommendations contained in the Consultation Paper on Superior Judiciary of September 26, 2001 submitted to the Ministry of Law and Justice by the National Commission to Review the Working of the Constitution.
The petition comes in the backdrop of the recent appointment of the former CJI, P. Sathasivam, as the Governor of Kerala.
