Rajasthan High Court chastises State police, says Deravar Singh’s case was not considered properly by the Director General of Police

The Rajasthan High Court has directed the State government to promote out-of-turn a Sub-inspector for displaying extraordinary courage while discharging his duties. The court also said Deravar Singh’s case was not considered properly by the Director General of Police in 2007.

Dismissing the plea to reject the case, in a 28-page order Justice Vineet Kothari even cited examples of western countries such as the U.S., the UK and Australia, and said Mr. Singh deserved to be promoted as an Inspector for his outstanding work.

The Court observed that to boost the morale of such police officers a special provision was enacted in the Service Rules and police reforms, which were recommended by the Supreme Court in 2001 in the case of one Prakash Singh. But the recommendations have largely not been implemented by the Centre and the State governments, Justice Kothari said.

In 2007, the then Superintendent of Police (Jodhpur Rural) recommended Deravar Singh’s case for out-of-turn promotion, citing 10 examples of exemplary work done by him, including saving the lives of six persons who were swept away in a truck in a flooded river in 2001, arresting a dacoit and arresting the leader of a gang of chain-snatchers. However, his case was rejected by the then Director General of Police which promoted him to move the court.

Despite getting a judgment in his favour, the case was rejected once again. Mr. Singh then filed another writ petition before the Rajasthan High Court and got a favourable order.

Rule 28 of Service Rules provides for reservation of 10 per cent vacancies for grant of such out-of-turn promotions, once in the entire service career, if a police officer does outstanding work in the field of anti-dacoity, anti-smuggling or in any other specified field of police work.

The court reiterated the need to implement these reforms and ordered that the promotion, with consequential benefits, be given to the petitioner.
