HC upholds Assam madrassa conversion

The Gauhati High Court on Friday upheld The Assam Repealing Act of 2020 for scrapping the Madrassa Education Provincialization Act.

The court also upheld all other notifications to convert 397 provincialized madrassas into general educational institutions.

Assam Chief Minister Himanta Biswa Sarma said the judgement was a landmark one.

State Governor Jagdish Mukhi had on February 3, 2021, assented to The Assam Repealing Act, 2020 under which all the government-run madrassas would run as upper primary, high and higher secondary schools with no change of status, pay, allowances and service conditions of the teaching and non-teaching staff.

The State Cabinet had on December 13, 2020, approved the proposal to repeal the provisions for madrassas and Sanskrit tols (schools).

The managing committees of many madrassas had opposed the government’s decision and approached the high court. The petitioners said the standard operating procedures for converting the madrassas into regular schools violated Article 29 and 30 of the Constitution of India.
