Even as the Maharashtra Cabinet is set to rethink its rejection of the Adarsh housing inquiry commission report, BJP leader and former MP Kirit Somaiya on Wednesday filed a police complaint against five politicians, including Union Home Minister Sushilkumar Shinde, who were named in it.
The Judicial Commission was set up by the State government following allegations that the Adarsh society high-rise was built in violation of norms with the complicity of politicians, bureaucrats and defence officials.
The Central Bureau of Investigation has already filed an FIR. However, Mr. Somaiya demanded that the Mumbai police too initiate an inquiry against the five politicians. Mr. Somaiya said all reports and papers available clearly showed that the crime had been committed. “The police have not taken any action till now. I have submitted all the reports and documents to the police authorities and registering an FIR is their duty now.”
The BJP leader has demanded that an FIR be registered under IPC Sections for fraud, cheating, forgery, money laundering and benami transactions.
However, sources in the police told The Hindu that they had not yet received any communication from the State government. “No action can be taken as the report has been rejected by the government,” said a senior officer on condition of anonymity.
Sources in the Anti-Corruption Bureau, competent authority to probe this case, said they could prosecute the accused only if court directed them to do so.
Meanwhile, the Cabinet is likely to discuss the Commission report at its meeting on Thursday, as Congress vice-president Rahul Gandhi last week asked the government to reconsider its decision.
