The Supreme Court has declined to interfere with an order passed by the Madras High court refusing to quash a criminal case against Puducherry Public Works Minister M.O.H.F. Shahjahan, pending before a trial court in Chennai.
A Bench of Justice B. Sudershan Reddy and Justice S.S. Nijjar dismissed, at the admission stage, the special leave petition filed by M.O.H. Iqbal and Mr. Shajahan against the High Court judgment dated April 15. In a brief order on Tuesday, it however, said “the petitioners' right to avail any other remedy is left open.”
The appellants said the respondent company, Agate Finance Ltd., had in a complaint stated that it had advanced funds to M/s M.O. Hassan Kuthoos Maricar Ltd., Puducherry, and they were the Director and Executive Director of the company.
The respondent company had filed a criminal complaint in relation to the financial transaction before XI Metropolitan Magistrate Court at Saidapet in Chennai. The appellants filed a petition in the High Court for quashing the proceedings but the High Court had rejected the plea. The present appeal is directed against this judgment.
