Interestingly, on September 28th, the court had admitted the petition and subsequently withdrew it.

Justice UR Udhvani of Gujarat High Court has recused himself from hearing the petition regarding alleged poll code violation by the Prime Minister Narendra Modi during the 2014 parliamentary polls. Mr. Modi had clicked a selfie holding the BJP's election symbol lotus outside the voting booth where he had exercised his franchise in Ahmedabad.

Justice Udhvani said “not before me” when the matter was mentioned in his court. Interestingly, on September 28th, the court had admitted the petition and subsequently withdrew it. “It will be referred to the acting Chief Justice, who will decide the Bench where the matter will be placed for hearing,” said a lawyer connected with the case.

The petition challenged the magisterial court order which accepted the Ahmedabad crime branch report giving clean chit to Mr. Modi.

The petition has been filed by Nishant Varma, a political worker with Aam Admi Party (AAP), who approached the High Court contending that Mr. Modi had violated the election code of conduct by clicking a selfie with his mobile in the voting booth and also addressing a press conference when the voting was underway.

The Election Commission of India had taken a strong view of the alleged offence, asking the Gujarat police to book Mr. Modi, who was then the Chief Minister of Gujarat and also PM candidate of the BJP. The Ahmedabad crime branch had lodged two FIRs naming Mr. Modi but in its probe report submitted in a magisterial court, the police filed a closure report.
