Opposing the plea of BJP State president P.S. Sreedharan Pillai for rescinding a criminal case registered against him, the government on Thursday informed the Kerala High Court that quashing of the case at this stage would affect the law and order situation in the State. The case has been registered against him under Section 505 (1)(b) of the Indian Penal Code (making a statement to cause fear or alarm among the public or to any section of the public whereby any person may be induced to commit an offence against the State or against public tranquillity) in connection with a speech delivered by him at a Bharatiya Janata Yuva Morcha meeting in Kozhikode.
In a statement filed in response to Mr. Pillai’s petition, the government pointed out that the BJP State president had prima facie committed the offence.
The government further submitted that the investigation in the case was in progress. The audio and visuals and the statement of Yuva Morcha workers, who attended the meeting, had to be recorded.
