Says they can drive transport vehicles

Persons holding licence to drive light motor vehicles are also entitled to drive transport vehicles of weight not exceeding 7,500 kg, the Kerala High Court has held. The order was passed by Justice K. Surendra Mohan on a group of petitions.

The petitioners, who were holders of driving licences issued by the Regional Transport Office, Tirur, wanted to have endorsement in their driving licences authorising them to drive transport vehicles.

Stipulation

However, the authorisation was denied citing that they had not passed Class 8. The petitioners contended that the stipulation on passing Class 8 for authorisation was unreasonable.

Gross weight

The government pleader argued that since the petitioners had not passed Class 8, authorisation permitting them to drive a transport vehicle could not be granted. The court pointed out that a light motor vehicle includes a transport vehicle as well and hence, a driver holding a light motor vehicle can drive all vehicles of the class, including a transport vehicle, the gross weight of which does not exceed 7,500 kg.
